Terms and Conditions Agreement for the E-course:

“Learning How to Use a Homeopathic Medicine Kit”


To access the online e-course, you must attest that you have read and agree to the terms and conditions contained in this e-course Terms and Conditions Agreement. The terms “e-course” and “course” includes the “Learn How to Use a Homeopathic Medicine Kit” e-course’s videos, ebook, PowerPoint presentation, and web pages, and all associated materials. Participants are encouraged to read this e-course’s Terms and Conditions Agreement carefully.

Participants of this e-course will be given access to the PowerPoint presentation which they can download directly to their computer, ipad, and/or cell phone.

Participants of this e-course will have access to the ebook and the various videos through the “cloud” for a period of five years. To avoid sharing of these educational materials to non-registered users, participants will not be able to save these educational materials to personal computers or cell phones. The Company will change the password to access the videos and the ebook approximately once a year. Participants can email the company to get the most recent working password.

Use of E-course Materials

The e-course, along with references used in or related to the e-course, are the property of HomeopathicFamilyMedicine.com or of third parties and used under permission granted to HomeopathicFamilyMedicine.com and may only be used in the manner detailed in this e-course’s Terms and Conditions Agreement.

Permission to use the material in any other way must be obtained in writing from HomeopathicFamilyMedicine.com and/or the publisher or author of the material. These materials are for the sole use of individuals registered for the e-course or others as approved by HomeopathicFamilyMedicine.com.

As an e-course registrant, you may view and read all materials that are part of the e-course. You may also print any or all screen and PDF file pages for your personal use in taking the e-course, but you may not share, communicate, publish or in any manner distribute to other parties the e-course’s videos or ebook, login and password, readings, or any other materials.

E-course Access

Only e-course registrants have access to the e-course content, including the videos, the ebook, and the PowerPoint slides. Each participant will be allowed access to the e-course for up to four different devices, as determined by the different IP addresses for each device. Participants can email HomeopathicFamilyMedicine.com to request access to additional devices, and permission for additional access will be determined on an individual basis.

Registrants to the e-course who share their access codes to non-direct family members will be prohibited from accessing the e-course materials, and there will be no reimbursement for remaining time on license.

The password to access the ebook will be changed approximately once-a-year to protect the intellectual property of the ebook.

General Disclaimer and HomeopathicFamilyMedicine.com Rights

Reference materials and links provided in the e-courses are provided by Dana Ullman and HomeopathicFamilyMedicine.com, neither of whom assumes responsibility or liability for the efficacy of recommendations provided or completeness of content contained in reference materials or links. Dana Ullman and HomeopathicFamilyMedicine.com does not vouch for the efficacy of any product or medicine for everyone, due to the individual idiosyncrasies of each person’s health.

The Right to Revise “Terms and Conditions”

HomeopathicFamilyMedicine.com reserves the right to revise these Terms and Conditions in its sole discretion at any time by posting the changes on its website (or that at Teachable.com). Changes become effective thirty (30) days after posting. The registrant’s continued use of the e-course after change become effective shall mean that the registrant accepts those changes. The registrant should visit the website regularly to ensure the registrant is aware of the latest version of the Terms and Conditions. Notwithstanding the preceding sentences of this section, no revisions to these Terms and Conditions will apply to any dispute between the registrant and the HomeopathicFamilyMedicine.com that arose prior to the date of such revision.

HomeopathicFamilyMedicine.com may modify the e-course or discontinue select videos or chapters from the ebook at any time.

The registrant is solely responsible for all service, telephony, data charges and/or other fees and costs associated with access to and use of the videos and ebook, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use.

Honoring laws and maintaining good faith

A registrant’s use, access, and other activities relating to the e-course must be in compliance with all applicable laws and regulations, including, without limitations, laws relating to copyright and other intellectual property use, and to privacy and personal identity. In connection with the registrant’s use of the e-course, the registrant must not provide incorrect or knowingly false information; copy, distribute, modify, reverse engineer, deface, tarnish, mutilate, hack, or interfere with the e-course or operation of the website; frame or embed the website or e-course; impersonate another person or gain unauthorized access to another person's Account; introduce any virus, worm, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment, or any other aspect of the e-course or operation of the website; scrape, spider, use a robot or other automated means of any kind to access the e-course.

Specific Obligations of Registrants of this E-course

If you are a registrant of this e-course, the following additional terms and conditions apply, and you represent, warrant and covenant that:

• You are over the age of 18, or, if not, you will only use the e-course with the involvement, supervision, and approval or a parent or legal guardian. Children under the age of 13 may not register for an account or register or purchase e-courses.

• You will not upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation (commercial or otherwise) through the website, the Facebook page for the e-course, or the e-course;

• You will not post any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, infringing, defamatory or libelous content;

• You will not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from or otherwise use and exploit any e-course Content (registrants will be allowed to use portions of the ebook in non-commercial ways but cannot copy more than 250 words without permission of HomeopathicFamilyMedicine.com, and whenever any words are used, the registrants agrees to give proper reference to the ebook as the original source);

• You will not disclose any personal information to an Instructor, and otherwise will assume responsibility for controlling how Your personal information is disclosed or used, including, without limitation, taking appropriate steps to protect such information; and

Registration

To access the e-course, registrants will need to register and obtain an account, username and password. When you register, the information you provide to us during the registration process will help us in offering content, customer service, and network management. You are solely responsible for maintaining the confidentiality of your account, username, and password (collectively, Your "Account") and for all activities associated with or occurring under Your Account. You represent and warrant that Your Account information will be accurate at all times. You must notify us (a) immediately of any unauthorized use of Your Account and any other breach of security, and (b) ensure that You exit from Your Account at the end of each use of the e-course. To the extent permissible under applicable law, we cannot and will not be responsible for any loss or damage arising from Your failure to comply with the foregoing requirements or as a result of use of Your Account, either with or without Your knowledge, prior to Your notifying us of unauthorized access to Your Account.

Refunds for E-courses

A refund will be considered if and when such requests are made within 15 days of payment for the e-course.

Effective Period

The e-course is designed to be completed at your own pace. You are responsible for completing the e-course on your own time. Participants will have access via the cloud for a five-year period of time beginning from the date of payment for the e-course, unless the Participant was found to have shared their e-course Password with a person who is not a member of the Participant’s immediate family.

Responsibility for Loss

You are responsible for and will indemnify and hold Dana Ullman, Homeopathic Educational Services, Homeopathic.com, and HomeopathicFamilyMedicine.com harmless from and against any and all liability, claims and losses resulting from your actions in connection with taking the e-courses and your breach of any terms and conditions of this e-course Terms and Conditions Agreement. Participants in this e-course are reminded that the recommendations of homeopathic medicines in this e-course are an adjunct to whatever other medical and health treatments they are using and that no part of this e-course is meant to say or suggest that one shouldn’t use whatever conventional medical treatment or psychological counseling advice another professional is recommending.

People who are sensitive or hypersensitive to medications

People who are sensitive or hypersensitive to conventional medications tend to be sensitive to homeopathic medicines too. People who are hypersensitive or allergic to multiple things need to use homeopathic medicines with care because such people can also be hypersensitive to homeopathic medicines. Such people should best use homeopathic medicines under the care of a professional homeopath.

Legal Conduct and Health Practice

Registrants may only access the e-course for lawful purposes. Registrants are solely responsible for the knowledge of and adherence to any and all laws, rules, and regulations pertaining to the use of the e-course. Taking this e-course does not mean that people can engage in the practice of medicine. It is recommended that registrants to consult with your country’s and your state or province’s laws about medical practice. While it is generally legal to prescribe most homeopathic medicines for yourself and your family, recommending or prescribing homeopathic medicines for non-family members may require some type of health or medical licensing.

Indemnification

Registrants hereby indemnify, defend and hold harmless the Company, and its affiliates, officers, directors, agents, partners, employees, licensors, representatives and third party providers from and against all reasonably foreseeable losses, expenses, damages, costs, claims and demands, including reasonable attorneys' fees and related costs and expenses, due to or arising out of the registrant’s breach of any representation or warranty hereunder. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the registrant, and in such case, the registrants agrees to fully cooperate as reasonably required with such defense and in asserting any available defenses.

Attestation

Dana Ullman and HomeopathicFamilyMedicine.com will deny access to this e-course to any individual who does not agree to the terms and conditions contained in this e-course Terms and Conditions Agreement. Further, Dana Ullman and HomeopathicFamilyMedicine.com reserves the right to terminate access to any individual who does not abide by these terms and conditions.

Violation voids the license and no reimbursement will be paid for remaining years on license.

Disciplinary Action

Registrants are deemed and presumed to be aware of and familiar with this e-course Terms and Conditions Agreement. Violation of Terms and Conditions will result in e-course termination and possible legal action.

E-course Management System Access

You agree that you will not use any robot, spider or other device, process or means to access the HomeopathicFamilyMedicine.com’s e-courses. Nor shall you use any process to monitor or copy our Web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not compromise or circumvent the security controls of HomeopathicFamilyMedicine.com’s e-courses or otherwise gain unauthorized access to HomeopathicFamilyMedicine.com e-courses. You agree that you will not use any device, software or routine that interferes with the proper working of the HomeopathicFamilyMedicine.com e-courses nor shall you attempt to interfere with the proper working of the e-courses. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works or publicly display any content from the HomeopathicFamilyMedicine.com E-courses without the prior expressed written permission of HomeopathicFamilyMedicine.com.

Electronic Notices

By using the e-course or communicating with Company, the registrant agrees that the Company may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the e-course or these Terms and Conditions. If the Company learns of a security system's breach that is traced to you, immediate action will be taken including blocking your account. The Company may attempt to notify you electronically by posting a notice on the e-course’s website or sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please write to Company at [email protected]

Arbitration

All disputes, controversies or claims arising out of or relating to this Agreement will be resolved through mandatory binding arbitration that will be conducted in Alameda County, California in accordance with established arbitration rules of the AAA. Any dispute must be initiated with an AAA arbitrator in Alameda County, California, within one year of occurrence or to the maximum extent permitted by law, and shall not be brought as a class action, a class arbitration, or any other proceeding where a person serves as the representative of any other person or persons. You agree that there is no right to a jury trial or representative action, and that this provision will be governed both substantively and procedurally by the AAA to the maximum extent permitted by law. Both parties must keep the dispute confidential, to the maximum extent permitted by law.

Miscellaneous

1. Entire Agreement. These Terms and Conditions and any policies applicable to the registrant posted on the website constitute the entire agreement between the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter.

2. Severability. If any provision of these Terms and Conditions is found to be illegal, void or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions of these Terms and Conditions.

3. Waiver. A provision of these Terms and Conditions may be waived only by a written instrument executed by the party entitled to the benefit of such provision. The failure of Company to exercise or enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision.

4. Notice. Any notice or other communication to be given hereunder will be in writing and given by facsimile, postpaid registered or certified mail return receipt requested, or electronic mail.

5. No Agency. Nothing in these Terms shall be construed as making either party the partner, joint venture, agent, legal representative, employer, contractor or employee of the other. Neither the Company nor any other party to this Agreement shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action that shall be binding on the other except as provided for herein or authorized in writing by the party to be bound.

6. These Terms and Conditions and the registrants use of the website and the e-course shall be governed by the substantive laws of the State of California without reference to its choice or conflicts of law principles.

Definitions:

“HomeopathicFamilyMedicine.com” and “The Company” refers to the producers of the e-course in “Learn to use a Homeopathic Medicine Kit.”

“Registrants” or “Participants” refers to those people who register to take the e-course.

The “e-course” refers to the set of 40, 60, or 80 videos, the ebook (“Evidence Based Homeopathic Family Medicine”), and a PowerPoint presentation on “Learn to use a Homeopathic Medicine Kit.”

The “ebook” (or e-book) refers to “Evidence Based Homeopathic Family Medicine.”

“Videos” refers to the set of 40, 60, or 80 videos that are a part of this e-course. Additional videos may be added to the e-course, though no additional fees will be asked retroactively for these videos.

“Facebook page for the e-course” refers to the Facebook page entitled “Learn how to use a homeopathic medicine kit e-course” (or a similar name to the same effect).
